Customs Brokerage Services Agreement

We agree that all transactions under this Agreement are subject to the standard trading conditions of the Canadian Society of On-Demand Brokers, which are found on the back of this Agreement, which have been read by the undersigned and which are included by reference in this Agreement. (a) The customs agent shall at all times provide services in a timely and professional manner, in accordance with generally accepted standards of the Canadian customs clearance industry and in accordance with all applicable laws and regulations of Canada and any province or territory thereof. (b) All information relating to the Customer is treated confidentially by the Customs Agent and his/her sub-agent, if any, and is only disclosed to the Canadian Customs Agent in accordance with the Customer`s legal provisions, in order to communicate the information to third parties. c) The customs agent will take all appropriate measures to provide services in accordance with the customer`s instructions, provided, however, that if the customs agent reasonably considers that the customer has an interest in derogating from the customer`s instructions, the customs agent has the power to do so and is compensated and avoided by the customer. (d) The customs agent makes available to the customer a copy of the accounting documents and / or related data for each transaction or summary accounting carried out on behalf of the customer. e) The customs agent shall promptly invoice the client for funds received to the extent that such funds are: I. for the client`s credit to the Receiver General for Canada or ii. by the customer, by advances referred to in paragraph 4, beyond the payments payable in respect of the customer`s transactions with Canadian customs or other government departments (f) The customs agent is not responsible for errors of assessment or what he may do or anything he may refrain from, nor for damages or losses resulting from the negligence of the customs agent or a case of force majeure or other acts or causes; which are not adequately controlled by the customs agent. . . .
